These Terms of Service govern your access to and use of www.inkarto.com, including all pages, features, services, products, offers, tools, content, communications, and transactions made through the website.
For the purpose of these Terms, “Inkarto”, “we”, “us”, “our”, or “the Company” refers to Parshwa Traders, operating the ecommerce brand Inkarto.com. “You”, “your”, “customer”, or “user” refers to any person who visits, browses, registers, places an order, communicates with us, or uses any part of the website.
By accessing the website, creating an account, placing an order, making a payment, using our services, or communicating with us through any official channel, you agree to be legally bound by these Terms, our Privacy Policy, Shipping Policy, Return & Refund Policy, and any other policy displayed on the website.
If you do not agree with these Terms, you must not use the website or place an order.
1. Eligibility to Use the Website
You represent that you are legally competent to enter into a binding contract under Indian law.
If you are below the age of majority, you may use this website only under the supervision and consent of a parent or legal guardian. By placing an order, you confirm that you are either legally competent or are using the website with appropriate parental or guardian consent.
We reserve the right to refuse access, cancel orders, suspend accounts, restrict COD facility, or block users where we reasonably suspect misuse, fraud, fake orders, abusive conduct, repeated RTOs, policy abuse, or violation of these Terms.
2. Nature of Our Business
Inkarto.com is an ecommerce platform engaged in the sale of stationery, art supplies, craft materials, journaling products, office stationery, packaging supplies, writing instruments, DIY materials, model-making products, and related goods.
Products sold on the website may include products manufactured, imported, packed, repacked, labelled, distributed, or resold by different manufacturers, importers, vendors, distributors, or brand owners. Unless expressly stated, Inkarto does not claim to be the manufacturer of every product listed on the website.
Where a product is sold under a third-party brand, the respective brand owner retains all applicable rights, warranties, specifications, and responsibilities attached to such product.
3. Product Information, Images and Display
We make reasonable efforts to display product information, images, colours, dimensions, weight, quantity, pack contents, features, and usage details as accurately as possible.
However, you acknowledge and agree that:
- Product colours may appear different due to screen settings, lighting, photography, batch variation, printing differences, material differences, and device display settings.
- Product images may include props, styling materials, packaging, backgrounds, or accessories for presentation purposes only.
- Minor variations in colour, shade, texture, print placement, size, finish, packaging, or design may occur due to batch changes, manufacturing changes, import variations, or supplier updates.
- Product descriptions are provided for general guidance and convenience.
- Actual product packaging, labels, manufacturer details, MRP, country of origin, importer details, batch details, and other declarations may vary by batch or supplier, subject to applicable law.
- Unless specifically mentioned, decorative items, props, backgrounds, or accessories shown in product images are not included.
A product shall not be treated as defective merely because of minor colour, texture, print, design, finish, packaging, or batch variation, provided the product remains substantially similar in nature, function, and value.
4. Legal Metrology, Labelling and Statutory Declarations
Inkarto endeavours to comply with applicable Indian laws relating to packaged commodities, including mandatory declarations where applicable.
For pre-packaged commodities, relevant declarations such as name and address of manufacturer / packer / importer, common or generic product name, net quantity, MRP, month and year of manufacture / packing / import, country of origin, customer care details, and other legally required information may appear on the product package, label, invoice, listing, or other applicable communication.
If you notice any missing, unclear, incorrect, or damaged label information on any product received from us, please contact our customer support immediately with photographs and order details.
5. Product Usage and Safety
Products sold on Inkarto.com must be used only for their intended purpose and in accordance with product instructions, labels, packaging, warnings, age recommendations, and ordinary care standards.
You agree that:
- Art, craft, resin, adhesive, cutting, sharp, chemical, ink, pigment, tool, miniature, magnetic, electrical, or small-part products must be used responsibly.
- Some products may not be suitable for children without adult supervision.
- Small parts may present choking hazards.
- Sharp tools, cutters, blades, craft knives, scissors, adhesives, resin materials, pigments, sprays, and chemicals must be used with proper care, ventilation, and safety precautions.
- Inkarto shall not be liable for misuse, unsafe handling, allergic reaction, improper storage, improper application, use contrary to instructions, or use by children without adult supervision.
Customers are responsible for reading product labels and instructions before use.
6. Pricing, MRP, Offers and Discounts
All prices displayed on the website are in Indian Rupees unless stated otherwise.
Prices, discounts, offers, coupon codes, combo prices, bundle prices, free shipping thresholds, COD charges, handling charges, and promotional benefits may change without prior notice.
We reserve the right to:
- Correct pricing errors.
- Cancel orders placed due to technical, typographical, system, discount, coupon, inventory, or pricing errors.
- Change, withdraw, limit, extend, or modify any offer at any time.
- Restrict offers to selected users, products, locations, order values, payment methods, or time periods.
- Reject or cancel orders where a coupon, offer, or discount has been misused.
- Cancel orders placed through automated bots, bulk abuse, duplicate accounts, fake accounts, or reseller misuse.
A price displayed incorrectly due to a technical error shall not create a binding obligation on Inkarto to sell the product at that incorrect price.
Where an order is cancelled after payment due to a pricing, stock, or technical error, the paid amount will be refunded as per our refund process and applicable payment gateway timelines.
7. Order Placement and Acceptance
Placing an order on the website does not automatically mean that the order has been accepted by us.
Your order is only an offer to purchase the selected products. Inkarto reserves the right to accept, reject, cancel, hold, partially fulfil, or modify an order subject to availability, payment verification, address verification, fraud checks, product restrictions, delivery feasibility, and internal order checks.
Order acceptance is deemed to occur only when the order is processed and handed over for dispatch.
We may contact you for order confirmation, COD verification, address verification, payment confirmation, bulk order clarification, or fraud prevention. If we are unable to verify your order or contact you, we may cancel or hold the order.
8. Stock Availability and Substitution
All products are subject to availability.
Sometimes, a product may become unavailable after you place an order due to inventory mismatch, warehouse error, supplier shortage, damage during quality check, batch change, or simultaneous orders.
In such cases, we may:
- Cancel the unavailable item and refund the amount paid for that item.
- Offer an alternative product, where appropriate.
- Ship the remaining products in the order.
- Cancel the full order if fulfilment is not commercially or operationally feasible.
We are not liable for any indirect loss, emotional distress, lost opportunity, loss of business, or inconvenience arising from product unavailability, delayed availability, or order cancellation, except to the extent required under applicable law.
9. Payments
We may provide multiple payment options, including prepaid payment methods, UPI, cards, net banking, wallets, payment gateways, and Cash on Delivery, subject to availability.
All online payments are processed by third-party payment service providers. Inkarto does not store your full card details, UPI PIN, net banking password, or payment credentials.
You agree that:
- Payment failure, gateway downtime, bank delay, chargeback, duplicate debit, or refund delay may be subject to bank / payment gateway timelines.
- Inkarto shall not be responsible for delays attributable to banks, card networks, UPI systems, payment gateways, or third-party payment processors.
- Orders may be held or cancelled if payment confirmation is not received.
- In case of suspected fraud, unauthorised payment, chargeback abuse, payment dispute, or suspicious transaction, we may cancel the order, suspend account access, restrict COD, and share relevant transaction details with payment partners, logistics partners, banks, or lawful authorities.
10. Cash on Delivery,
Fake Orders and RTO Abuse Cash on Delivery is offered at our discretion and may not be available for all pin codes, customers, products, order values, or past-order behaviour.
We reserve the right to disable, restrict, or cancel COD orders where:
- The customer has a history of refusing deliveries.
- The customer has provided an incomplete, false, unreachable, or suspicious address.
- The customer does not answer verification calls or messages.
- Multiple COD orders are placed using the same number, address, device, or identity.
- The order appears to be fake, abusive, fraudulent, or placed with no genuine purchase intent.
- The pin code is not serviceable or has high delivery failure risk.

Any COD advance, if applicable, is not paid.
If a COD order is refused, undelivered, or returned due to customer non-cooperation, incorrect address, non-availability, refusal to accept, or failure to pay, we may restrict future COD orders and recover applicable shipping, RTO, handling, or operational costs to the extent permitted by law.
11. Shipping and Delivery
Shipping timelines displayed on the website are estimates and not guaranteed delivery dates.
Delivery may be affected by courier delays, weather, strikes, festivals, high-volume sale periods, operational disruptions, incorrect address, remote location, force majeure events, government restrictions, customer unavailability, courier capacity, or reasons beyond our control.
You agree to provide accurate shipping details, including full name, mobile number, alternate contact number where possible, complete address, landmark, pin code, and any required delivery instructions.
Inkarto is not responsible for delays or failed delivery caused by incorrect address, customer unavailability, refused delivery, locked premises, restricted entry, or non-responsive customer communication.
Risk of loss or damage shall pass to the customer once the product is delivered to the address provided by the customer or to a person receiving the shipment on behalf of the customer.
12. Damaged, Missing or Wrong Products
If you receive a damaged, missing, incorrect, defective, or tampered product, you must report it within the timeline stated in our Return & Refund Policy.
To protect both customers and Inkarto from false claims, we may require:
- Clear unboxing video from sealed package opening to product verification.
- Images of outer packaging, shipping label, invoice, product, barcode, and damage.
- Order ID and registered contact details.
- Any other reasonable proof required to verify the claim.
Claims may be rejected if:
- The opening video is edited, incomplete, unclear, paused, or starts after package opening.
- The product has been used, altered, damaged after delivery, or not preserved in original condition.
- The claim is made after the applicable reporting window.
- The evidence does not support the claim.
- The issue is caused by misuse, mishandling, improper storage, or normal wear and tear.
Approval of replacement, refund, partial refund, store credit, or rejection shall be determined after verification and in accordance with our Return & Refund Policy and applicable law.
13. Returns, Replacements and Refunds
Returns, replacements, exchanges, cancellations, and refunds are governed by our Return & Refund Policy, as updated from time to time.
Not all products may be eligible for return or exchange. Products may be non-returnable due to hygiene, safety, usage nature, clearance sale, combo offer, free gift, customised packaging, damage risk, fragile nature, or other product-specific reasons clearly stated on the website or policy page.
Returned products must be unused, undamaged, complete, and in original packaging with all tags, labels, accessories, manuals, free gifts, and invoice, unless the return is due to a verified defect or wrong product.
Refunds, where approved, will be processed to the original payment method, store credit, coupon, or other method as per our policy and applicable payment gateway timelines.
Shipping charges, COD charges, gift wrapping charges, handling fees, express shipping charges, convenience fees, and other non-product charges may be non-refundable unless required by applicable law or unless the issue is attributable to Inkarto.
14. Cancellations by Customer
Customers may request cancellation only before the order has been packed, processed, shipped, or handed over to the courier.
Once an order is packed, shipped, or dispatched, cancellation may not be possible. The customer may then follow the applicable return process after delivery, subject to eligibility under the Return & Refund Policy.
For prepaid orders, approved cancellations will be refunded as per the applicable refund timeline.
For COD orders, repeated cancellation, refusal, or non-acceptance may lead to COD restriction.
15. Cancellations by Inkarto
Inkarto may cancel any order, fully or partially, without liability, including in the following cases:
- Product is out of stock.
- Product is damaged during quality check.
- Pricing, discount, coupon, or listing error.
- Payment is not confirmed.
Delivery address is incomplete, incorrect, suspicious, or not serviceable. - Customer is unreachable.
- Order appears to be placed for resale, fraud, abuse, or policy misuse.
- Bulk purchase is attempted without prior approval.
- Product is restricted from shipping to the destination.
- Operational, courier, legal, or compliance issue prevents fulfilment.
- Force majeure or event beyond reasonable control.
Where payment has been received and the order is cancelled by us, the eligible amount will be refunded as per our refund process.
16. Promotional Offers, Coupons, Combo Offers and Free Gifts
Promotional offers, coupons, sale discounts, bundles, combo deals, cashback, vouchers, free gifts, and loyalty benefits are discretionary and may be modified, withdrawn, extended, restricted, or cancelled at any time.
Unless specifically stated:
- Offers cannot be combined with other offers.
- Coupons may be valid only for selected products, users, categories, order values, or time periods.
- Free gifts are subject to availability.
- Images of free gifts are for illustration only.
- If a free gift is unavailable, Inkarto may replace it with another item of equal, lower, or higher value at its discretion, unless prohibited by law.
- Free gifts cannot be exchanged, returned, encashed, or separately claimed.
- If the main product is cancelled or returned, the free gift must also be returned unused and complete.
- If the free gift is not returned, its value may be deducted from the refund to the extent permitted by law.
- Misuse of coupons, duplicate accounts, fake orders, bulk abuse, or manipulation of offers may lead to order cancellation and account restriction.
Any “free” claim, discount claim, scarcity claim, or promotional representation shall be subject to actual campaign terms, product availability, and applicable law.
17. Bulk Orders, Resellers and Institutional Purchases
Bulk orders, wholesale orders, reseller orders, corporate orders, school orders, institutional orders, or B2B purchases may be subject to separate pricing, terms, payment rules, GST treatment, shipping terms, cancellation terms, and return eligibility.
Inkarto reserves the right to treat an order as a bulk, reseller, or institutional order based on quantity, frequency, account behaviour, product type, or commercial indicators.
Retail discounts, consumer offers, free gifts, and return policies may not apply to B2B, wholesale, customised, or institutional orders unless expressly agreed in writing.
18. User Accounts and Customer Information
You are responsible for maintaining the confidentiality of your account login details and for all activities under your account.
You agree to provide accurate, complete, and updated information while creating an account, placing an order, requesting support, or participating in any promotion.
You must not:
- Create fake accounts.
- Impersonate another person.
- Use false contact information.
- Misuse another person’s payment method.
- Abuse coupon codes or referral systems.
- Interfere with website operations.
- Use bots, scrapers, automation, or unauthorised scripts.
- Attempt unauthorised access to the website, servers, customer data, or systems.
We may suspend or terminate accounts that violate these Terms.
19. Customer Communication
By placing an order, creating an account, subscribing, contacting support, or submitting your details, you consent to receive transactional communications from Inkarto through email, SMS, WhatsApp, phone calls, courier calls, app notifications, or other communication channels.
Transactional messages may include order confirmation, payment update, shipping update, delivery update, OTP, invoice, support response, return update, refund update, and important account or policy information.
Marketing communications will be handled in accordance with applicable law and our Privacy Policy. You may opt out of marketing communications where required, but transactional communications necessary for order fulfilment may continue.
20. Reviews, Feedback, Images and User Content
If you submit reviews, testimonials, images, videos, feedback, suggestions, comments, social media tags, or other content to Inkarto, you grant Inkarto a non-exclusive, royalty-free, worldwide right to use, reproduce, publish, display, edit, translate, distribute, and promote such content for business, marketing, quality improvement, and customer education purposes.
You confirm that any content submitted by you:
- Is truthful and based on your genuine experience.
- Does not infringe third-party rights.
- Is not abusive, defamatory, obscene, misleading, fraudulent, or illegal.
Does not contain malware, spam, or harmful material. - Does not disclose personal information of others without consent.
Inkarto may remove, moderate, reject, or edit user content where it violates these Terms, law, platform policy, or brand standards.
21. Intellectual Property
All website content, including brand name, logo, layout, graphics, product photography, banners, text, icons, videos, designs, packaging concepts, product descriptions, website structure, marketing material, and other content is owned by or licensed to Inkarto, unless otherwise stated.
You may not copy, reproduce, scrape, download, modify, publish, sell, distribute, reverse engineer, commercially exploit, or use any website content without prior written permission.
Third-party brand names, trademarks, logos, and product images belong to their respective owners and are used only for identification, resale, description, or lawful commerce.
22. Prohibited Uses
You agree not to use the website, services, products, or content for:
- Illegal, fraudulent, harmful, or unauthorised purposes.

- Reselling products purchased under retail offers without prior approval.

Violation of this clause may result in order cancellation, account restriction, COD blocking, legal action, and reporting to appropriate authorities.
23. Third-Party Services
The website may use third-party services such as Shopify, payment gateways, logistics partners, analytics tools, marketing tools, review tools, WhatsApp tools, email tools, and other integrations.
Inkarto is not responsible for errors, downtime, breaches, delays, failed payments, delivery delays, technical issues, or service interruptions caused by third-party platforms, banks, payment gateways, logistics partners, hosting providers, telecom providers, or technology service providers.
Your use of third-party services may also be governed by their respective terms and policies.
24. Privacy and Personal Data
Your personal information is collected, processed, stored, shared, and protected in accordance with our Privacy Policy and applicable Indian law.
By using the website, placing an order, contacting support, or submitting personal information, you agree to the collection and use of your information for order processing, payment confirmation, shipping, customer support, fraud prevention, legal compliance, marketing where permitted, and business operations.

25. No Unlawful or Misleading Use

26. Disclaimer of Warranties

Our total liability for any claim relating to an order shall not exceed the amount actually paid by you for the specific product giving rise to the claim, except where applicable law requires otherwise.
Nothing in these Terms limits liability for fraud, wilful misconduct, gross negligence, or liability that cannot be restricted under applicable law.
28. Indemnity
You agree to indemnify and hold harmless Inkarto, Parshwa Traders, its owners, officers, employees, agents, vendors, suppliers, contractors, service providers, logistics partners, payment partners, and affiliates from any claim, demand, loss, liability, damage, penalty, cost, or expense arising out of:
- Your breach of these Terms or website policies.
- Your misuse of products.
- Your false information or fraudulent conduct.
- Your violation of law.
- Your violation of third-party rights.
- Your abusive, defamatory, misleading, or unlawful communication.
- Your misuse of COD, refund, return, coupon, or promotional systems.

29. Force Majeure
Inkarto shall not be liable for delay, non-performance, cancellation, delivery failure, stock shortage, service interruption, or inability to fulfil obligations due to events beyond reasonable control, including natural disasters, floods, fire, epidemic, pandemic, strikes, lockdowns, labour issues, transport disruption, courier disruption, government action, war, civil unrest, internet failure, cyberattack, payment gateway failure, supplier failure, import delay, regulatory restriction, or other force majeure events.

We will endeavour to acknowledge customer grievances within the timeline required under applicable law and resolve them as soon as reasonably possible, subject to the nature of the complaint, verification requirements, courier dependency, payment gateway dependency, internal investigation, and applicable website policies.
Please include your order ID, registered mobile number, email address, clear description of the issue, and relevant photographs/videos wherever applicable.
Customers are requested to first contact our customer support team for ordinary order-related issues. Matters requiring escalation may be addressed to the Grievance Officer at tickets@inkarto.com.
31. Governing Law and Jurisdiction
These Terms shall be governed by and interpreted in accordance with the laws of India.
Subject to applicable consumer protection laws and statutory remedies available to consumers, the courts and competent authorities at Sangli, Maharashtra shall have jurisdiction over disputes arising from these Terms, website use, or transactions with Inkarto.
Nothing in this clause shall restrict any consumer from exercising rights available under applicable consumer protection laws.
32. Dispute Resolution
Before initiating formal proceedings, you agree to first contact Inkarto customer support and provide a reasonable opportunity to resolve the issue.
Where a dispute cannot be resolved amicably, the parties may explore mediation, settlement, or other lawful dispute resolution methods.
Any arbitration clause, if separately agreed in writing, shall be subject to the Arbitration and Conciliation Act, 1996 and applicable law.
